1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the website, platform, and services (collectively, the "Services") provided by Fukugu K.K. ("Fukugu", "we", "us", or "our").
Fukugu is a Type 2 Fund Transfer Service Provider registered with the Kanto Local Finance Bureau (Registration No. 00059) under the Payment Services Act of Japan.
By accessing or using our Services, you agree to be bound by these Terms.
2. Scope of Services
Fukugu provides payment, fund transfer, settlement, and related financial services, including access to supporting systems, platforms, and integrations.
Certain services, products, or features may be subject to additional terms and conditions ("Service-Specific Terms").
Where applicable, such Service-Specific Terms will be made available on the relevant product or service website or interface, and shall form an integral part of these Terms. In the event of any inconsistency, the Service-Specific Terms shall prevail to the extent of such inconsistency.
3. Acceptance of Terms
By accessing our Services, registering an account, or submitting a transaction instruction, you:
- confirm that you have read and understood these Terms;
- agree to be legally bound by them.
If you do not agree, you must not use the Services.
4. Eligibility and Registration
You must:
- be at least 18 years old;
- have the legal capacity to enter into binding agreements;
- comply with applicable laws and regulations.
Fukugu may refuse or reject any registration at its discretion.
5. Account and Security
You are responsible for:
- maintaining confidentiality of your account credentials;
- all activities conducted through your account.
You must notify us immediately of any unauthorised use.
6. Compliance and Verification
Fukugu conducts identity verification in accordance with applicable laws, including the Act on Prevention of Transfer of Criminal Proceeds.
You agree to provide accurate information and cooperate with verification.
Fukugu may request additional information, suspend, or refuse Services where necessary.
7. Use of Services
You agree to:
- use the Services lawfully;
- provide accurate transaction information;
- not act on behalf of third parties without authorisation.
Transactions may not be cancellable once processed.
8. Transactions
Transactions are executed upon receipt of required funds and completion of checks.
Fukugu may delay, suspend, or refuse transactions where necessary.
Processing times are estimates only.
9. Fees
Fees will be disclosed prior to execution or otherwise agreed.
Fukugu may modify fees at any time.
10. Refusal and Suspension
Fukugu may suspend or terminate Services where:
- required by law or regulation;
- suspicious activity is detected;
- information is inaccurate;
- these Terms are breached.
11. Risk Disclosure
You acknowledge that:
- Fukugu is not a bank;
- services are not deposit products;
- funds are protected under the Payment Services Act security deposit system.
12. Outsourcing
Fukugu may engage third-party service providers.
13. Intellectual Property
All rights in the Services are owned by Fukugu.
14. Limitation of Liability
To the extent permitted by law:
- Fukugu is not liable for indirect or consequential loss;
- Fukugu is not responsible for delays caused by external factors.
Nothing excludes liability where prohibited by law.

16. Anti-Social Forces
You confirm no association with anti-social forces.
Fukugu may terminate Services upon breach.

Terms may be updated and take effect upon publication.
19. Governing Law
Governed by Japanese law. Tokyo District Court has jurisdiction.
20. Language
Japanese version prevails in case of inconsistency.
